Weekly Question!

A recent Tenth Circuit opinion discussed the difference, if any, between "meaningful benefit" vs. "some benefit" for the FAPE standard. Which should be the standard? Do you think that there is a difference?

  1. Currently schools that accept Title 1 Funds under ESEA have a higher expectation of growth for students with disabilities. There is a significant gap between IDEA and ESEA in terms of expected growth an benefit.

    How is a studnet to have access and make progress in the general curriculum if the benefit the IEP conveys is not significant. Students with disabilities fall further and further behind their peers when we aren't expecting meaningful growth.
